How to claim the right to allowance for assistance and care at home?

Answer: An elderly person who is infirm, a seriously ill person and another person who is
unable to take care of him/herself has the right to assistance and care at home.
In order to exercise the right to assistance and care at home, you need to fill out a request
for it, which contains the full name of the applicant, that is, the name and surname of the
person for whom the request is submitted, address, contact phone number, as well as the
reason for submitting the request.
(You can find the request in electronic form on the website of the Municipality of Berkovići
or fill it out in person at the Municipal Administration premises (Service for Social
Protection).
Along with the completed application, the following documents are required:
- photocopy of ID card,
- a photocopy of the current bank account,
- finding and opinion of the family doctor about the need for assistance and care of another
person,
- medical documentation (not older than 6 months).

How to exercise the right to permanent financial assistance?

Answer: The right to financial assistance can be exercised by an individual or a family whose
members are unable to work, who do not have their own income or whose total income for
living is below the amount of financial assistance established by law, who do not have excess housing space, who do not have other property whose value can provide means of support, who do not have living support obligees in accordance with the Family Law or if those obligees of support due to disability or other objective impediments are not able to support and fulfill the obligation of support. In order to exercise your right to financial assistance, you need to fill out an application, which contains the full name of the applicant, that is, the name and surname of the person for whom the application is submitted, address, contact phone number, as well as the reason for submitting the application. (You can find the
application in electronic form on the website of the Municipality of Berkovići or fill it out in
person at the Municipal Administration premises (Service for Social Protection). Along with
the completed application, the following documents are also required:
- photocopy of ID card,
- photocopy of current bank account,
- Statement on the members of the family household (household list),
- certificate from RS administration for geodetic and property affairs on non-possession of
property,
- PDI Fund confirmation of non-realization of pension rights,
- income certificate,
- certificate of work incapacity.

What is a building permit?

Answer: The decision on the building permit is an administrative act on the basis of which
construction, additions, upgrades, reconstruction and rehabilitation of the building can be
started.

What documentation is necessary for issuing a building permit?

The following documents must be attached to the request:

- location conditions;
- urban - technical conditions;
- a copy of the cadastral plan for the construction plot formed according to urban-technical
conditions with identification of the old and new survey;
- proof of resolved property-legal relations (ownership certificate, land - registry extract,
etc.);
- main project (3 copies);
- project audit report (except for individual residential and residential-business buildings
with gross construction area up to 200.00 m2);
- consents prescribed by special laws (e.g. agricultural, fire prevention consent, etc.);
- decision on the amount of compensation for construction land development
- payment in the amount of 0.3% of the estimated contribution value;
- municipal administrative fee.
A copy of the cadastral plan and proof of ownership must be original and cannot be older
than 6 months.
In the case where the party in the proceedings is represented by a proxy, a power of
attorney must be attached to the request.

What is a use permit?

Answer: The built facility cannot be used, that is, put into use, before the competent
authority issues a use permit, based on a previously performed technical inspection of the
facility. The use permit can be issued for the entire facility or for a part of it that represents a
separate technical and functional entity, when it can be brought to its intended purpose
before the completion of the construction of the entire facility and in the case when it is
necessary for the continuation and completion of the construction.

Who submits a request for a use permit?

The use permit request is submitted by the investor, that is, the owner of the building or his
legal successor, or the contractor, when together with the supervisory authority, they
determine that the building or part of it was built in accordance with the building permit.

What documentation is necessary for issuing a use permit?

The following documentation must be attached to the request:
- building permit with a project of the completed state,
- certificate of completed geodetic recording of the object,
- proof of completed recording of underground installations,
- consent to the completed state, when it is provided for by special laws
- the contractor's statement for all phases of the work performed
- report of the supervisory body
- energy certificate of the building
- proof of payment of the administrative fee
In the case when the party in the proceedings is represented by a proxy, a power of attorney
must be attached to the request.

What is an environmental permit?

Answer: Appropriate environmental protection regulations apply to facilities where activities
that endanger or may endanger the environment are carried out. Before submitting a
request for a decision on building permit, and if required by location conditions, the investor
is obliged to first obtain an environmental permit.

What documentation is necessary for issuing an environmental permit?

The following documentation must be attached to the request:
- location conditions;
- evidence (two copies) prepared by institutions authorized by the Republika Srpska Ministry
of Spatial Planning, Construction and Ecology;
- Proof of payment of the administrative fee.
In the case when the party in the proceedings is represented by a proxy, a power of attorney
must be attached to the request.

How to get the location conditions?

Answer: The following documentation must be attached to the application form:
- urban planning - technical conditions and expert opinion if there is no spatial planning
implementation document
- a copy of the cadastral plan (not older than 6 months)
- proof of the legality of the existing building, if it is an extension, upgrade or change of
purpose of the existing building (original);
- description of the facility;
- consents or opinion on the location of the facility provided for in the urban planning and
technical conditions and based on special laws depending on the type and purpose of the
facility (communal and public institutions), if such consents are not included in the urban
planning and technical conditions;
- decision on determining the obligation to conduct an environmental impact assessment
and the scope of the impact assessment, if its implementation is mandatory in accordance
with special regulations;
- conceptual design and proof of ownership or the right to build on land for buildings for
which, according to the provisions of the law, a building permit is not required;
- proof of payment of the administrative fee

Location conditions are issued within 15 days from the day when the request is fully
completed.

What does the legalization of illegally built buildings mean?

Answer: Legalization implies the procedure of issuing a decision which determines the
legality of all buildings built before the end of 1991, as well as for individual residential and
residential-business buildings, with the gross construction area less than 400 m2, and for
auxiliary buildings that are the function of the parent building, and were built by Dec 21,
2013.

What must be attached to the request for a decision on legalization?

Answer: The request for issuing a decision on legality must followed with:
- a copy of the cadastral plan,
- title deed (immovable property deed),
- land - registry extract,
- geodetic survey of the object,
- purchase contract or construction contract,
- technical documentation, etc.

When does the decision on legalization replace the subsequent use and building permit?

Answer: For individual residential and residential-business buildings, for which property-
legal relations have been resolved, the decision on legality replaces the subsequent building
and use permit, and they can be registered after the issuance of the decision on legality.
